Terms of Service

Plain-language summary. Planorial creates and revises concept-stage floor-plan images. You must have the rights to material you submit, use the Service lawfully, review every result, and involve qualified professionals before relying on a plan for dimensions, permits, safety, structure, accessibility, cost, or construction. AI outputs can be inaccurate and non-unique. Free access and paid Stripe checkout do not change those limitations.

1. Acceptance and eligibility

These Terms of Service (“Terms”) govern access to the website and tools branded as Planorial (the “Service”). By using the Service, creating an account, or submitting content, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Service.

You must be at least 18 or the age of legal majority where you live, unless an authorized adult or organization can accept these Terms for you. If you use Planorial for an organization, you represent that you can bind it. “Planorial,” “we,” and “our” refer to the Service operator. Its legal entity, address, and jurisdiction must be published before commercial launch.

2. The Service

Planorial is an online workspace for creating, comparing, downloading, editing, and re-rendering concept-stage floor-plan images. Controls may include space type, dimensions, area, units, room requirements, layout preferences, a brief, visual style, and source image. A browser canvas may support basic planning interactions.

The public workspace sends AI requests through Planorial’s server to a configured model provider. Signed-out recent results may exist only in the page session; signed-in History is kept for 30 days, with up to nine results. Account, support, storage, credit, and payment capabilities may not all be enabled in every deployment.

3. Accounts and security

Some features require an account. Provide accurate information, protect passwords and sign-in links, and do not share access with unauthorized people. You are responsible for account activity unless law provides otherwise. Report suspected compromise promptly.

We may offer email/password or configured third-party sign-in, subject to the provider’s terms. Complete self-service account deletion is not currently available; submit closure or privacy requests through Support Tickets.

4. Your inputs and source images

“Input” means a prompt, measurement, selection, source image, support message, feedback, or other material you submit. You retain whatever rights you lawfully hold in your Input. You represent that you have all permissions necessary to upload and process it and that doing so does not violate privacy, confidentiality, intellectual-property, contractual, property, or other rights.

You grant the operator and necessary providers a limited, non-exclusive, worldwide license to host, copy, transmit, transform, and process Input to operate, secure, support, and improve the requested Service, enforce these Terms, and comply with law. It lasts as reasonably needed, subject to processors, backups, disputes, and legal duties. Do not submit confidential security details, personal records, payment-card images, or a third party’s plan without authorization.

5. Generated outputs

“Output” means an image, enhanced brief, summary, or result produced from Input. Subject to law and provider terms, we do not claim ownership merely because an Output passed through the Service. This does not guarantee that an exclusive right exists; you must determine whether and how it may be used.

AI Output may be inaccurate, incomplete, inconsistent, misleading, similar to another result, or contain unintended objects, text, and artifacts. Planorial does not promise originality, uniqueness, non-infringement, dimensional accuracy, or fitness. Review every Output. Signed-out History may be lost after refresh or navigation, and signed-in History expires after 30 days, so download material you need to keep longer.

6. Acceptable use

You may not use the Service to:

• break a law, court order, sanction, or another person’s rights;
• upload material you do not have permission to process;
• generate or distribute malware, abusive content, fraud, impersonation, harassment, or unlawful discrimination;
• expose personal information, access credentials, private residential-security details, or confidential records without authorization;
• probe, bypass, disable, or overload authentication, rate limits, access controls, or infrastructure;
• reverse engineer the Service except where a non-waivable law permits it;
• automate high-volume requests, scrape results, resell access, or use multiple identities to evade limits without written permission;
• inject instructions intended to obtain secrets, hidden prompts, provider credentials, or unrelated system behavior;
• misrepresent an Output as surveyed, engineered, code-compliant, professionally approved, or construction ready; or
• use the Service in a way that materially interferes with another user or creates unreasonable technical, legal, or safety risk.

We may investigate misuse, limit requests, preserve relevant records, remove access, or report conduct when legally required.

7. Professional and construction-use boundary

Planorial is an early planning tool, not an architect, engineer, surveyor, contractor, code official, accessibility consultant, or safety service. Outputs are not CAD or BIM deliverables, permit drawings, structural calculations, surveys, certifications, cost estimates, or construction instructions.

Do not build, buy materials, submit permits, value property, represent boundaries, or make safety decisions from Output without verification. Existing conditions, structure, utilities, fire safety, egress, accessibility, zoning, and codes require proper measurement and qualified review. You remain responsible for the project.

8. Availability and product changes

We may modify, test, restrict, suspend, or discontinue features, models, limits, interfaces, or providers. Maintenance, security events, outages, abuse controls, and experiments can interrupt the Service. We do not promise uptime, response time, a model, format, browser, storage period, or roadmap unless a signed agreement says otherwise. Urgent security or legal action may occur without notice.

9. Fees, credits, subscriptions, and billing

The Pricing page identifies the product, price, currency, billing interval, credit allowance, refresh or expiry behavior, and payment provider. Stripe displays the final total before authorization. Those checkout disclosures supplement these Terms.

You authorize Stripe to process a purchase. Planorial records order and subscription references rather than a complete card number; Stripe controls payment credentials inside its embedded form. Credits are feature-use units, not money or transferable value. The Pricing page states expiration, rollover, and failed-request reversal rules. Mandatory consumer and refund rights remain unaffected.

10. Intellectual property and feedback

The Service, software, interface, branding, documentation, and operator-created content are protected by law. No license is granted to trademarks, source code, datasets, or proprietary materials beyond the right to use the Service. Third-party components retain their licenses.

Feedback may be used, reproduced, modified, and incorporated worldwide, permanently, and without payment or credit. This does not transfer ownership of floor-plan Input or private support content.

11. Third-party services

Planorial may depend on AI, hosting, storage, authentication, email, analytics, and payment providers with separate terms, privacy practices, availability, and locations. We are not responsible for an independent site merely because we link to it. Using a feature authorizes transfers necessary to complete it as described in the Privacy Policy.

12. Suspension and termination

You may stop using the Service or request account closure through Support Tickets, subject to verification and required retention. We may restrict access for a Terms violation, risk, unpaid authorized charge, security need, legal duty, or provider requirement.

Where appropriate, we will try to give notice, but immediate action may be necessary. Feedback rights, incurred payment obligations, disclaimers, liability limits, and dispute terms survive as needed.

13. Disclaimers, liability, and responsibility

To the fullest extent permitted by law, the Service and Outputs are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness, title, non-infringement, accuracy, and quiet enjoyment. We do not warrant uninterrupted operation, error-free results, preserved content, or professional or regulatory suitability. Some exclusions may not apply where prohibited.

To the fullest extent permitted by law, the operator and its providers are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profit, revenue, goodwill, data, or opportunity; or costs from reliance on Output. Aggregate liability for free use will not exceed USD $100; for paid use it will not exceed the greater of USD $100 or fees paid for the affected Service during the prior six months. Liability that cannot legally be limited remains unaffected.

Where law permits, you will defend and indemnify the operator from third-party claims caused by Input you lacked rights to submit, unlawful use, or a material Terms violation, with prompt notice and a reasonable chance to participate.

14. Changes, governing law, and contact

We may update these Terms. The “Updated” date identifies the current version. Material changes will receive additional notice when required. Continued use after the effective date means acceptance; otherwise stop using the Service.

This pre-commercial draft imposes no optional arbitration clause, class waiver, or exclusive forum. Mandatory law remains available. Before paid launch, the operator must publish its identity, governing law, venue, address, and legal contact. Review the updated Terms before purchase.

Submit notices through Settings → Support Tickets. If account access is unavailable, use the public contact method when published. An unenforceable provision will be limited as necessary; the rest continue. Failure to enforce is not a waiver.
